The auction site eBay, sentenced in France in June to pay some 40 million euros at luxury group LVMH to counterfeiting, was dismissed today in Paris of his request for waiver of penalty of 50,000 euros per day tied to his conviction, said LVMH.

The decision by the Cour d'appel de Paris concerning the injunction made "eBay to stop the sale of perfumes and cosmetics bearing the marks Dior, Guerlain, Givenchy and Kenzo, under penalty of a fine of 50,000 euros, day of delay, "the group said in a statement.

It does not pay 38.83 million euros in damages to six brands of global luxury leader LVMH, which eBay was sentenced June 30 by the commercial court, for forgery and illegal sale. It is the largest amount which it has ever been convicted in Europe.

The auction site American announced it was calling and would continue to sell the items brands LVMH until the decision of the appellate court
